Our Terms and Conditions of Coach Hire 

Deposits & Balances 

a) All deposits are non-refundable and non-transferable once received by ‘Oakley’s’. 

b) Any balance owing to ‘Oakley’s’ must be paid in full prior to commencement of the journey.

 

Methods of Payment 

a)  ‘Oakley's’ will accept payment by cash, card and bank transfer. We no longer accept payment by cheque unless by prior arrangement.

 

Passengers 

a) The maximum Legal number of passengers allowed to travel in our coaches will be advised on the front of the reservation form. 

b) ‘Oakley’s’ reserve the right to refuse entry to any person deemed unfit to travel for any reason (e g intoxicated etc). 

c) All passengers must be on board and ready to depart at the time agreed when the coach was booked. 

d) Extra costs can occur if departure is delayed due to passengers arriving late to board the coach. 

e) An additional charge may be added if your hire exceeds the times agreed and paid for. 

f) ‘Oakley’s’ ask that passengers remain in a fit state to travel and do not consume excessive amounts of alcohol prior to or during your hire, this is due to your own safety being compromised.

 

Weather and Traffic Conditions 

a) ‘Oakley’s’ accept no responsibility for adverse weather conditions, (snow, flooding etc). Which may cause delay or cancellation of the journey by ‘Oakley’s’. 

b) In the event of cancellation by ‘Oakley's’ due to weather condition, you will have the opportunity to move your booking to a new date, or a credit note will be given to you to use at a later date. 

c) ‘Oakley’s’ accept no responsibility for missed connections, functions or consequential loss, however caused. eg traffic, weather or breakdown.

 

Vehicle Breakdowns 

a) Every effort is made to ensure your coach is well maintained, but breakdowns can still occur. 

b) The company gives its advice on journey time in good faith. However, as a result of breakdown or traffic congestion, or other events beyond the reasonable control of the company, journeys may take longer than predicted and in those circumstances the company will not be liable for any loss or inconvenience suffered by the hirer as a result.

 

Extraordinary Charges 

a) ‘Oakley’s’ reserve the right to charge £25.00 cleaning fee for tracking mud, debris etc into the coach 

b) Excessive spillage of beverages by passengers will be charged at £25.00. 

c) Breakage of any interior fitment by your coach party will be charged at £50.00 per breakage. 

d) Damage to any seating by your coach party will be charged at £100.00 per tear/hole/ graffiti marks. 

e) Passengers who are sick inside of the coach will be charged at £50.00 for interior/exterior cleaning of the coach. (Sick bags are provided on request.) 

f) Failure to pay extraordinary charges may result in court proceedings for which an additional £50.00 or 10% of the amount outstanding (whichever is greater) will be added to your account.

 

General 

a) Smoking and the consumption of hot food are not permitted in ‘Oakley’s’ coaches under any circumstances. 

b) Passengers are permitted to bring their own alcohol/food and drink onto the coach but only with prior arrangement with the company. 

c) ‘Oakley’s’ cannot accept any responsibility for the loss or damage to any items left on or carried in the coach by passengers. 

d) ‘Oakley’s’ cannot accept responsibility for any injuries caused by passengers walking around when the vehicle is in motion. Passengers should remain seated when the vehicle is moving.

 

Driver hours and rest periods.
a) The hours agreed with the Operator for the operation of any hire must be strictly observed (other than in the case of serious emergency or diversion) so that regulations governing drivers hours and rest periods can be complied with. 

b) The Operator reserves the right to curtail or otherwise alter any hire which does not comply with the relevant regulations. Neither the Hirer nor any passenger shall delay the departure of a vehicle or otherwise interrupt the journey so putting the driver at risk of breaching the regulations relating to drivers hours of work and duty. 

c) The Hirer will indemnify the Company against any extra expenses or charges which the Company may incur including, but not limited to the cost of providing a replacement driver.

 

Cancellation by the Hirer
If the hirer cancels, the following scale of charges will apply:

 

Cancellation more than 7 days before the hire date - no charge

Cancellation between 7 days and 48 hours before the hire date - 50% of the hire charge

Cancellation within 48 hours before the hire date - full charge, no refund will be given

 

Cancellation by the Company
a) In the event of circumstances beyond the company’s control e.g. civil unrest, strikes, police road closures, terrorist attacks etc (including adverse weather and road conditions) or in the event of the hirer taking any action varying agreed conditions unilaterally the company may, by returning all money paid and without further liability cancel the contract of hire agreed.

 

Vehicle to be Provided
a) The company reserves the right to provide a larger vehicle than that specified unless specifically instructed not to do so. In such circumstances no additional charges will be levied. The company reserves the right to substitute another vehicle (including those of other operators) or ancillary facilities for all or part of hiring subject to substitutes being of equivalent value.

 

Complaints
a) In the event of a complaint the hirer should seek a solution at the time from the driver or company. If a remedy has not been provided, complaints should be submitted in writing to the General Manager within 14 days of termination time of hire.
